Justice Okogbule Gbasam of the High Court in Rivers State, Port Harcourt, affirmed the membership of Martin Amaewhule and 26 other lawmakers aligned with Nyesom Wike in the People’s Democratic Party (PDP). The ruling came on Monday, June 10, in response to a case brought by Hyacinth Amadi, Godspower Obuah, and Tonye Darius seeking to declare the lawmakers’ seats vacant.
According to Daily Trust, Justice Gbasam dismissed the plaintiffs’ claim, noting their failure to prove that Amaewhule and the lawmakers had defected to the All Progressives Congress (APC). The judge emphasized that party membership must be substantiated by being listed on the party’s register or possessing a membership card, and not by public statements or televised ceremonies.
The PDP intervened in the case as the fourth defendant upon request, and Justice Gbasam ruled that the Rivers state government must recognize the 27 lawmakers as members of the PDP. Consequently, the government is obligated to uphold all laws passed by the Assembly under their tenure, as they remain legally recognized members of the party and have not vacated their legislative positions.
